Scott McMillan was also labeled a vexatious litigant in McMillan v. Weathersby (9th Cir. 2002) 31 F.App’x 371, 374, a label the appellate court did not find was abusive. argument of Scott McMillan and affirmed the dismissal of the lawsuit brought by
