Scott McMillan Attorney La Mesa Vexatious

Scott McMillan San Diego attorney has his small office near the railroad tracks in La Mesa, California. Scott McMillan is also the Dean of the failed law school, McMillan_Academy_of_Law , and was forced to inform potential applicants that in over ten years – the school has NOT had a single graduate:

"We have had one student take the First Year Law Students' Examination and that student passed. This is the basis for the 100% pass rate thus far. As of yet, no students have graduated from the Academy."

In Lycurgan, Inc. v. Todd Jones Filed (ATF Chief), Ninth Cir., Case No. 15-55228, SDCA Case No. 3:14-cv-01424, the court decided to dismiss yet another case of Scott McMillan, attorney San Diego, where it said, "Accordingly, we dismiss this appeal for lack of jurisdiction. DISMISSED."  What can be almost as embarrassing is the fact Scott McMillan , La Mesa attorney , sued the ATF and engaged in a years of litigation. Ultimately, Scott McMillan appealed and came before the federal appellate court. The senior judge on the panel called Scott McMillan’s lawsuit “silly” and not based on principle. Scott McMillan was seated behind volumes of papers while the judge demeaned his case. Embarrassed and defeated again , Scott McMillan had to accept his lawsuit was a waste of time. Personally, I hope Scott McMillan made the only right choice his lawsuit and decided to donate the volumes of papers he so needlessly burdened the court and government with.

Scott McMillan sued the ATF twice and lost twice, then lost both appeals. Scott McMillan alleged federal agents intimidated him, vandalized his client's property, and stole property. See Scott McMillan declaration. To date the upstanding federal agents have not been prosecuted, which makes me think the declaration is false as I would hope our government would not employ people who do such things. San Diego attorney Scott McMillan wasting judicial resources is very concerning to me, and it is not the first time Scott McMillan was called a vexatious litigant. See McMillan v. Weathersby (9th Cir. 2002) 31 F.App'x 371, 374. [Appeal from the United States District Court for the Southern District of California. D.C. No. 95-CV-3934TW(LAB).
